The Injuries
Our clients have been injured while disconnecting the Blue Ox SwayPro hitch from the towing vehicle. A special latch wrench is used to unhook the spring bars from the trailer. While the hitch was being disconnected, the wrench violently swung in the opposite direction and struck our clients in the face.
As a result, our clients have suffered broken jaws, eye injuries, facial injuries, lost teeth requiring implants, long-term concussive symptoms, and even brain injuries.
Expert Findings
Goldenberg Lauricella has retained a mechanical engineering expert to evaluate the Blue Ox SwayPro as part of our clients’ cases. The expert has inspected the Blue Ox SwayPro system and run it through a series of tests connecting and disconnecting the system and trailer from a tow vehicle. The expert found that the hazard in using the Blue Ox SwayPro hitch and weight management system comes when disconnecting the system from the tow vehicle. The problem is that the disconnection process causes a sudden and violent change of force in the wrench used to unhook the spring bars.
The expert concluded that this change of force can cause the user to lose control of the wrench, and the wrench can begin to rotate rapidly with significant force. If the user remains in the vulnerable position needed to release the locking pin, significant injuries can occur. The expert also found that similar products by other manufacturers use an alternative design that does not have the same risks as the Blue Ox SwayPro. This makes the product “unreasonably dangerous.”
Our clients have stated that they followed all directions in the Blue Ox SwayPro manual for connecting and disconnecting the system from the vehicle. The product manual does not properly warn of the possibility of the sudden and unexpected release of force when the latch goes over-center. Nor is there any warning on the product itself.
