With discovery on many issues being complete in the ongoing Valsartan litigation, both plaintiffs and defendants have served reports from their experts who will testify at trial. Both the plaintiffs’ and defendants’ attorneys have filed their Daubert briefs. These briefs allow each side to argue which expert testimony they believe should be included in the litigation moving forward. After hearing oral arguments, Judge Kugler will issue an order detailing whether any experts’ opinions will be excluded in whole or in part.
The parties are also in the process of briefing class certification. Once the class certification briefs are filed, Judge Kugler will decide whether or not a class should be certified.
There are currently three different class actions pending in the Valsartan MDL:
- Consumer class action brought by consumers who purchased contaminated Valsartan.
- Medical monitoring class action brought by consumers who are seeking medical monitoring as a result of their exposure to the presence of nitrosamines in their valsartan pills.
- Third-party payor class action, brought by entities like insurance companies who paid for the contaminated drugs.
