Johnson & Johnson’s Phantom Recall

According to reports, after learning that certain Motrin pills were not dissolving properly in 2008, Johnson & Johnson sent “secret shoppers” to buy the pills back from some 5,000 retail locations. This was in an apparent effort to avoid additional attention from the FDA in a year during which the company’s manufacturing processes were under heavy scrutiny.

The initial lawsuit against the consumer products giant ended in a consent agreement with the federal government that required Johnson & Johnson upgrade manufacturing facilities to reduce quality-control issues such as the one impacting Motrin. Reopened in 2015 by an appellate court, the case has now resulted in a $400,000 settlement to the state of Oregon, where officials claimed the effectiveness of the product had been misrepresented, placing consumers at “material risk.”
