What Should I Do If I Get Hurt on Someone Else’s Property?

There is a duty to exercise reasonable care to ensure that persons are protected from an unreasonable risk of harm while in stores, on public property, and in other people’s homes. An owner is therefore obligated to inspect their house or building for dangerous conditions and to either repair or sufficiently warn visitors about such dangers. If the owner knows about a dangerous condition and fails to appropriately repair it or warn about it, the owner may be held liable for people’s injuries caused by that danger.

Injuries Can Occur as a Result of the Following:

  • Wet floors
  • Uneven steps
  • Falling objects
  • Defective elevators
  • Defective parking lots and sidewalks
  • Poorly lit staircases
  • Inadequate security
  • Aggressive dogs

Steps After an Injury on Another's Property

  • Seek medical attention immediately
  • Take photographs of the dangerous condition
  • Gather and preserve relevant information such as the names and contact information of witnesses and anyone who can describe the dangerous condition (the lights, the security, the flooring, timeline of events, and other relevant details).
  • Preserve evidence such as the shoes and clothing you were wearing when the injury occurred. Make sure that these items are secure and are stored without having been washed, cleaned, or changed in any way.
  • File or obtain a copy of the police or incident report. If the injury occurred in a place of business, notify the manager and file an incident report. If the injury involved an attack, get a police report. Also, get copies of medical personnel’s reports.
  • Preserve your medical and expense records
  • Do not sign anything without obtaining legal advice. You may be contacted by the party who caused the injury or their insurance company to discuss a settlement or sign a release form.  However, it is important to first receive legal guidance from a lawyer who specializes in personal injury cases to ensure that your interests are protected. Contact the Personal Injury Attorneys at GoldenbergLaw who will provide you with sound advice.
