Case Quick Facts

Injury Statistics

According to the CPSC, in 2014, there were an estimated 251,800 toy-related injuries treated in U.S. hospital emergency departments. This number is comparable to the estimated number of toy-related injuries from 2010 to 2014, for all individuals.

Who Is the Most Vulnerable?

Males accounted for 147,500 (59{73438c93b9a6e6bfc5cd31bf6578637c675720219417f2f1a65e7c8e6c24cfa4}) of the estimated toy-related injuries in 2014. Most of the deaths were related to getting hit by a car on a toy such as a scooter.

Due to their smaller upper airways and tendency to put everything in their mouths, children under age three are most at risk for choking on a toy.

Common Household Hazards

Balloon strings and other items with strings account for several deaths each year. Parents often tie balloons or other items with strings to their child’s crib leading the child to grab hold of the string and wrap it around his or her neck.

Unanchored Furniture

Each year, companies recall dressers, shelving, and bookcases that fall on children. Children are more susceptible to tip-over accidents due to their height and that they may try to climb or stand on furniture to access something out of reach. Manufacturers may be liable for injuries that were the result of defective furniture or tip-over accidents.

Lately, spinners have become the toy of choice. The US Consumer Product Safety Commission has warned that these toys have small parts and can break creating a potential choking hazard.

True Story

“John” was a 5-year-old boy using a Hasbro Easy-Bake Oven. Unlike older models of the oven which were heated using a light bulb, Hasbro had created a new design featuring a heating element inside that could heat up to 400 degrees. Under his mom’s supervision, John mixed the batter and put the cake pan into the oven through a slot that was much larger than the traditional oven. Curious to see into the oven, John put his hand through the slot and pushed up on the flap. Due to the hot temperature, John decided to take his hand out. Suddenly, the flap closed and his little hand was trapped inside. His mother rushed over and was able to pry his hand out of the oven opening. John consequently sustained burns from the extreme temperatures and was taken to the hospital and ultimately left with some scarring. The family contacted our toy injury attorneys in Minneapolis and we began our investigation against this defective design. After coordination with the Consumer Products Safety Commission, the defective Easy-Bake oven was recalled. After extensive litigation, a confidential settlement was obtained for the family.
