What Are Standards of Care?

GoldenbergLaw has been pursuing medical malpractice cases for several decades. There is a common misconception that the outcome of treatment alone determines the viability of a medical malpractice case. However, medical malpractice has a legal definition that requires you to prove much more than only a negative or unexpected outcome.

Medical malpractice occurs if a physician deviates from the standard of care. In legal and medical terms, a “standard of care” is the diagnostic process or treatment that a reasonable, competent medical professional is expected to follow in a given case.

The medical profession is extremely complicated and there is not always a formula that dictates the right treatment or course of action. The standard of care simply lays the groundwork for physicians’ decisions. There is not always a “right” and “wrong” for every situation; a lot is left up to interpretation and experience.

Medical malpractice cases are exceptionally complicated. In addition to proving that the doctor violated the standard of care, you must also be able to prove that that violation directly caused the injury. The injury must also be substantial enough to warrant the significant expenditure associated with medical malpractice cases.

At GoldenbergLaw, our Minnesota medical malpractice and wrongful death lawyers have decades of experience helping innocent victims pursue justice and compensation for injuries or losses that result from the negligence or misconduct of a medical professional.
