Camp Lejeune Claim Submission Deadline Fast Approaching

CDC Study Links New Injuries to Camp Lejeune

new study released by the Centers for Disease Control (CDC) found that Marines and civilians who lived at Camp Lejeune during the contamination period in the 1970s and 1980s were more likely to be diagnosed with certain injuries compared to personnel at a similar base in California. The new injuries identified are currently not included in the Justice Department’s elective option settlement program 

The elective option splits nine qualifying diseases into two injury tiers and awards values based on the client’s time of exposure to the contaminated water. The elective option settlement values range from $100,000 to $550,000 depending on injury tier and duration of exposure during the contamination period, respectively.

Camp Lejeune Plaintiffs Fight for Jury Trials

In early February, a group of North Carolina judges who are overseeing the Camp Lejeune litigation ruled that the Camp Lejeune Justice Act does not clearly and affirmatively grant a right to a jury trial. Plaintiffs are looking to appeal this ruling on the grounds that the Camp Lejeune Justice Act grants plaintiffs the right to present their claims to a jury. Goldenberg Lauricella has also taken a proactive approach to this issue, as bellwether trials will begin later this year regardless of the Court’s ruling. We believe that we can recover for our clients regardless of a trial by bench or by jury. 

Causation In Dispute

Plaintiffs have also brought a motion for partial summary judgment on causation. The motion argues that the Camp Lejeune Justice Act does not require any proof that the contaminated water at Camp Lejeune caused any individual’s specific injury. Rather, the Act only requires proving that the contaminated water could cause the specific type of injury. If this motion is successful, this will reduce the time each bellwether trial takes and greatly increase the success of all claims.
